Bankruptcy Myths Part 4
In this article I will share the final 2 myths about bankruptcy that many people believe.
Myth #13 – “Creditors can still hound me”
On the contrary, once your case goes before the court, the judge can issue a restraining order prohibiting your creditors from trying to get you to pay your debts through phone calls, letters, billings, notices of demand or any other form of communication. If any creditor continues to do so, he is breaking the law and is subject to punishment. Once you engage me as your attorney, all you need to do is inform me and I will take it up on your behalf.
Myth #14 – “I cannot remove previous tax debts”
Besides being well versed with the bankruptcy code, I am also a tax attorney. And I can tell you for sure that this myth is only half true. The truth is that you can wipe out tax debts of more than 3 years provided you meet certain conditions. This applies to income tax. On the other hand, sales tax cannot be removed by filing for bankruptcy and they must be paid up.
